If you or your client’s property rights have been stripped away by the arbitrary actions of local governments, you need to pay attention to this message!
Senate Bill 205 (formerly known as House Bill 765) passed out of the House Regulatory Reform Committee earlier this week and we are hoping that it will be brought to the House Floor for a vote in the coming days. This bill is a significant measure that seeks to further clarify local government authority related to land use decisions.
Specifically, the bill does the following:
- Reaffirms that local development regulations must fall within the limits of state law.
- Maintains local control over setbacks, lot sizes, buffers, and development fees.
- Establishes a timeline for the plan submittal and approval process.
- Prevents unauthorized local requirements that unnecessarily drive up the cost of development.
Please ask your State House Representative to support Senate Bill 205.
One of the things SB 205 hopes to accomplish legislatively is prevent unnecessary barriers that are put in place to slow down or prevent development projects from obtaining approval. In fact, the Grant of Power section of the legislation states that it permits local governments to impose lawful conditions through zoning regulations, but precludes a local government from including unlawful conditions as a prerequisite for project approval in its zoning regulations.
